TL;DR

QuestionAnswer
Who is the agreement with?Buun Group Pty Ltd ("Buun Group", "we", "us"), ABN 75 687 193 675, Queensland, Australia.
Who may agree?Anyone aged 16 or over. If you use Plotwork for a business or an organisation, you agree for it and say you may.
How do I pay?Pro is paid in advance through Stripe for each billing period. Cancelling stops the next charge; Pro stays until the end of the period you paid for.
Who owns my diagrams? You do. You give us only the permission we need to draw, store and serve them for you.
Can I rely on the service? We work to keep it running, but the Free plan comes with no promise of availability, and no plan is promised to be free of interruption. An Enterprise contract can set a service level.
What may I not do?Anything the acceptable use policy forbids.
How does it end?You can delete your account at any time on the Settings page of the portal, or ask us to. We can suspend or close an account that breaks these terms.
Does an Enterprise contract change this?Yes. Where a signed contract differs from these terms, the contract wins.
Which law applies? The law of Queensland, Australia. Your rights under the Australian Consumer Law, or the consumer law of your own country, are not reduced by anything here.

Accounts

RuleDetail
One person, one accountAn account belongs to the person whose email address signs in to it. Do not share the sign-in.
Keys are secretsAn API key acts as you, or as the organisation that made it. Keep it out of public places, and revoke a key you think was seen. You are responsible for calls made with your keys until you revoke them.
OrganisationsThe owner of an organisation decides who belongs to it, their roles, and its settings. The organisation is the owner's account for billing, and its diagrams belong to it.
Accurate detailsKeep the email address on your account one you can read: it is how we sign you in and tell you about your account.

Plans and payment

RuleDetail
PlansWhat Free, Pro and Enterprise include is on the plans and billing page. We may change what a plan includes; a change that takes away something you pay for applies from your next billing period after we tell you.
PaymentPro is charged in advance for each billing period to the card you give Stripe. Prices include any tax the checkout shows.
Renewal and cancellationPro renews at the end of each period until you cancel. Cancelling on the Plan page stops the next charge, and Pro stays until the end of the period you paid for.
RefundsA period already started is not refunded, except where the law requires it or we decide to.
Failed paymentIf a charge fails and is not paid after Stripe's retries, the account moves to Free. Diagrams over the Free plan's limits are then kept for the time the Free plan keeps them.
Plans we giveA plan Plotwork gives at no charge lasts for the time we said, and then the account moves to Free unless you pay.
EnterpriseAn Enterprise organisation's price, limits, term and support are in its signed contract.

Your content

Your content is the diagram source you send, the pictures drawn from it, the names, folders and settings you choose, and anything you upload, such as an icon or a brand color.

RuleDetail
You own itNothing in these terms gives us ownership of your content.
Our permissionYou let us process, store, copy and serve your content only to run Plotwork for you: to draw it, to keep what you publish or save, to show it to the people you share it with, and to keep backups. The permission ends when the content is deleted, apart from copies in caches and backups that expire on their own.
What is keptDiagram source is worked on in memory and not stored, unless you publish, save, or turn on a setting that keeps it. The privacy policy and the data retention policy say exactly what is kept and for how long.
Public linksA personal hosted diagram is served at a public link that cannot be guessed. Anyone given the link can see it. Do not publish to a public link what must stay private; publish to an organisation instead.
Your responsibilityYou must have the right to send and publish your content. Content that breaks the law or the acceptable use policy may be removed.
Product marksThe icons draw product marks that belong to their owners. The trademarks and icons page says how they may be used.

Our service

RuleDetail
What we doWe provide Plotwork with reasonable care and skill, and fix problems we learn about in reasonable time.
ChangesWe improve Plotwork often. We may change, add or remove features. We tell account holders before we remove a feature a paid plan includes.
AvailabilityPlotwork runs on Cloudflare's network. It can be interrupted by maintenance, by our providers, or by events outside our control. The Free plan has no promise of availability. A service level, where there is one, is in an Enterprise contract.
LimitsEach plan has daily call limits and hosting limits. A call over a limit is refused, not charged.
FeedbackIf you send us an idea or feedback, we may use it without owing you anything for it.
The npm package and the self-hosted engineThe packages you run on your own machine are covered by their own licences. These terms cover the hosted service.

Suspension and ending

RuleDetail
You can leaveDelete your account at any time on the Settings page of the portal, or ask at legal@buungroup.com (opens in a new tab); the privacy policy says what is removed. Cancel Pro first if you do not want the next charge.
We can suspendWe can suspend an account, a key or an organisation that breaks these terms or the acceptable use policy, puts others at risk, or that the law requires us to stop. Where we can, we say why and give you a chance to fix it first.
We can closeWe can close an account for a serious or repeated breach. We can also stop offering Plotwork, with at least 60 days' notice to paid accounts and a refund of any period paid for and not used.
After it endsYour content is deleted as the data retention policy describes. The sections on your content, liability, disputes and law, and the general terms continue to apply.

Liability

RuleDetail
Consumer guaranteesNothing in these terms excludes, restricts or changes a right or remedy you have under the Australian Consumer Law, or under a consumer law of your own country, that cannot lawfully be excluded.
Where the law allows a limitFor a service that is not of a kind ordinarily acquired for personal, domestic or household use, our liability for a failure to meet a consumer guarantee is limited, where the law allows, to supplying the service again or paying the cost of having it supplied again.
Indirect lossWe are not liable for loss of profit, revenue, data or goodwill, or for indirect or consequential loss, except where the law does not allow this to be excluded.
Total limitOur total liability under these terms in any 12 months is limited to the fees you paid us in those 12 months, or 100 Australian dollars if you paid nothing, except where the law does not allow a limit.
Your partYou are responsible for your content and for calls made with your keys, and you cover our reasonable costs of a claim brought against us because of content you published or a breach of the acceptable use policy.

Disputes and law

These terms are governed by the law of Queensland, Australia. If something goes wrong, write to legal@buungroup.com (opens in a new tab) first, and we will try to settle it with you directly. If it is not settled within 30 days, either of us may take it to the courts of Queensland, Australia. A consumer may also use the courts and dispute services of their own country where the law gives them that right.

General

RuleDetail
Changes to these termsThe date at the top says when they last changed. A change that reduces your rights is emailed to the address on your account at least 30 days before it applies. Using Plotwork after a change applies means you accept it.
The whole agreementThese terms, the acceptable use policy, and the policies they link to are the whole agreement for the hosted service, unless you have a signed contract with us.
If a part failsIf a court finds part of these terms unenforceable, the rest still applies.
AssignmentYou may not transfer your account or these terms without our agreement. We may transfer them to a company that takes over Plotwork, and will tell you if we do.
NoticesWe write to the email address on your account. You write to legal@buungroup.com (opens in a new tab).
